  • Limits on attorney charges. Social Security also limits how much of your back benefits an attorney can collect. The government sets a maximum dollar amount for lawyers, which can change year to year. And it puts a 25 percent overall cap on lawyer fees. So your lawyer can collect up to 25 percent of your retroactive benefits, or the dollar limit, whichever one is smaller.

And remember, they can’t charge a penny until you win.
