What to Do After a Veterans’ Disability Denial

After a VA denial, it’s understandable to feel overwhelmed. You were counting on this. Then it didn’t come through for you.

Don’t delay acting for your appeal, though. The clock is ticking. In most cases, you have one year from your rating decision to file an appeal.

Steps you need to take after you receive a denial:

  • File a Notice of Disagreement with the VA.
  • The VA will then create a Statement of the Case, which is a detailed explanation of why your claim was denied.
  • File a response with a “substantive appeal” document, or VA Form 9.
  • You can elect to have a personal hearing for your appeal.
  • The Board of Veterans’ Appeals makes its decision.

You can submit new evidence at any point during this process.

We know this seems daunting. We know the system and we know how to make your case as strong as possible.
